Terms of Service

These Terms of Service ("Terms") govern your use of the website gtastycoffee.pro (the "Website"), operated by GTasty Coffee GmbH. They also contain the consumer information required under German civil law (§§ 312, 312d BGB in conjunction with Art. 246a § 1 EGBGB).

2. Subject of the Website

The Website is a showcase for our coffee products. It displays product information and prices and provides a contact form for enquiries. The Website does not include an online shop, shopping cart or checkout function. Orders or purchase requests are handled individually by email after you contact us.

3. Contract Formation

Because purchases are arranged by email, a contract for the sale of goods (§ 433 BGB) is only concluded when we expressly accept your request by email (order confirmation). Prices shown on the Website are non-binding invitations to request an offer (§ 145 BGB).

4. Prices and VAT

All prices shown on the Website are in Euro (EUR) and include the statutory German value-added tax (VAT) at the applicable rate, in accordance with § 19 UStG where applicable and otherwise at the standard rate. Shipping costs, where applicable, are communicated in the order confirmation before you commit to a purchase.

5. Right of Withdrawal (Consumers)

If you are a consumer within the meaning of § 13 BGB, you have a statutory right of withdrawal for distance contracts under §§ 312g, 355 BGB. The detailed instructions and the model withdrawal form will be provided with your order confirmation. The withdrawal period is fourteen days from the day you, or a third party designated by you, take physical possession of the goods.

We are liable for material and legal defects in accordance with the statutory provisions (§§ 437, 434 BGB). If you are a consumer, the statutory limitation period for claims is two years from delivery of the goods (§ 438 (1) No. 3 BGB).

7. Use of the Website

You agree to use the Website only for lawful purposes and not to misuse the contact form, for example by submitting false, misleading or abusive content. We reserve the right to ignore or block enquiries that constitute misuse.

8. Intellectual Property

All content on the Website (texts, images, layout, logo and the "GTasty Coffee" brand) is protected by intellectual property law. You may not copy, reproduce or use it for commercial purposes without our prior written consent.

9. Liability

We are liable without limitation for intent, gross negligence, injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz). For slight negligence we are only liable for a breach of essential contractual duties (cardinal obligations) and only in the amount of the typically foreseeable damage.

10. Applicable Law

These Terms and all contractual relationships are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, the mandatory consumer protection provisions of your habitual residence remain unaffected where they are more favourable (Art. 6 Rome I Regulation).

11. Alternative Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), available at ec.europa.eu/consumers/odr. We are not obliged or willing to participate in dispute settlement proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).
